EB-1A vs EB-2 NIW: Which Self-Petition Green Card Fits You?

The EB-1A and the EB-2 National Interest Waiver (NIW) are the two main US green cards you can file for yourself, with no employer and no labor certification. The EB-1A is for people at the very top of their field who can show sustained acclaim, while the NIW is for people with an advanced degree or exceptional ability whose work has national importance. The EB-1A has a higher bar but usually a shorter wait; the NIW is easier to qualify for but shares the often longer EB-2 queue.

EB-1A: extraordinary ability

The EB-1A is for the small share of people who have risen to the very top of their field in the sciences, arts, education, business, or athletics. You qualify with a major internationally recognized award (such as a Nobel Prize or an Olympic medal), or with evidence of at least 3 of 10 criteria, for example:

  • nationally or internationally recognized prizes
  • membership in associations that require outstanding achievement
  • published material about you in major media
  • judging the work of others
  • original contributions of major significance
  • scholarly articles
  • a leading or critical role for distinguished organizations
  • high salary compared with others in your field

Meeting 3 criteria is not enough by itself. USCIS then looks at the whole record to decide whether you really are among the top in your field.

EB-2 NIW: national interest waiver

The EB-2 NIW has two layers. First you must qualify for EB-2, through an advanced degree or exceptional ability. Then you must pass the three-part test from Matter of Dhanasar:

  1. Your proposed work has substantial merit and national importance.
  2. You are well positioned to advance it, based on your education, skills, record, and plans.
  3. On balance, it would benefit the US to waive the usual job offer and labor certification.

The NIW does not require fame. Researchers, engineers, doctors, and entrepreneurs with a clear plan and a solid record often qualify.

Building your evidence

The same kinds of documents support both petitions, but they are used to prove different things:

Independent letters, from experts who know your work but have not worked with you, usually carry more weight than letters from colleagues. Be accurate: exaggerated claims can lead to denial or a finding of misrepresentation.

Waits and costs

Both categories are subject to annual limits and per-country caps, so your country of birth matters. People born in India and China wait longer in both, and EB-2 has often had longer waits than EB-1 for other countries too. Check the Visa Bulletin tracker and read priority dates.

What changed in 2026

  • A USCIS memo (PM-602-0199, May 21, 2026) says people on temporary visas should get green cards inside the US only in extraordinary circumstances, which affects the final step for many EB-1A and NIW applicants in the US.
  • Immigrant visa interviews at consulates have been frozen worldwide since August 25, 2026.
  • The Gold Card also uses EB-1 and EB-2 visa numbers, adding a new group of applicants.
  • Nationals of travel ban countries face suspended immigrant visas and USCIS holds.

Who should choose which?

Choose EB-1A if you:

  • have major awards, significant press coverage, or other evidence that you are among the very top of your field
  • were born in a country where EB-1 moves faster than EB-2
  • do not have an advanced degree but have an outstanding record

Choose EB-2 NIW if you:

  • have a master's or PhD, or a bachelor's plus 5 years of progressive experience
  • have a clear, nationally important project and a record that shows you can advance it
  • are strong but not yet "top of the field"

Consider both. Many applicants file an NIW first and an EB-1A later as their record grows, or file both at once. An approved EB-2 priority date can usually carry over to a later EB-1 petition. If you currently need a work visa, compare H-1B vs O-1.

Is EB-1A harder than EB-2 NIW?

Yes, the evidence standard is higher. EB-1A requires sustained acclaim at the top of your field, while the NIW requires an advanced degree or exceptional ability and nationally important work.

Can I file EB-1A and EB-2 NIW at the same time?

Yes. Each is a separate Form I-140, and some people file both to improve their chances or to use whichever priority date moves faster.

Do I need a job offer for EB-1A or NIW?

No. Both are self-petitions. For EB-1A you must show you will continue working in your field in the US, and for the NIW you must show a plan for your proposed work.
